1. Acceptance

By creating an account or using Surven, you agree to these Terms of Service. If you don't agree, please don't use the service.

2. Service description

Surven is a Generative Engine Optimization (GEO) platform that scans your business presence across AI tools (ChatGPT, Claude, Gemini, Google AI) and reports your visibility, mentions, and citation gaps. We may add, remove, or modify features at any time. The Surven Auditor Chrome extension is part of the Service when installed.

3. Your account

You're responsible for keeping your login credentials secure and for any activity under your account. Notify us immediately if you suspect unauthorized access. You must be at least 18 years old to use Surven.

4. Acceptable use

You agree not to misuse the service. Specifically:

No scraping or abusing rate limits;
No attempting to break security or probe for vulnerabilities;
No using Surven to harass others or violate any law;
No reverse-engineering, decompiling, or attempting to derive the source code of the service;
No using Surven to build or train a competing product;
No reselling, sublicensing, or commercially redistributing the service or its output without our written permission;
No automation that exceeds reasonable human-scale usage of the dashboard or APIs;
No using the Chrome extension's auto-fix functionality on a site you don't own or aren't expressly authorized by the site's owner to modify.

If you violate this section, we may suspend or terminate your access immediately and without notice.

5. Billing & refunds

Paid plans are billed monthly or annually depending on your selection. You can cancel anytime from Settings → Billing; cancellations take effect at the end of the current billing period and you keep access through then. The Plus plan starts with a 14-day free trial that requires no credit card. The Premium plan has no free trial and is billed from the date of purchase. Subscription time already paid for is not refunded.

6. Data & privacy

How we collect and use your data is described in our Privacy Policy. You retain ownership of your data; you grant us a license to process it solely to provide the service.

7. Disclaimers

Surven is provided "as is" and "as available," without warranties of any kind, express or implied. AI tools change frequently, and visibility results may shift outside our control. We make no guarantees about specific ranking outcomes, uptime, or that the service will be uninterrupted or error-free.

8. Limitation of liability

To the maximum extent permitted by law, Surven's total cumulative liability to you for any claim arising out of or relating to these Terms or the service is limited to the amount you paid Surven in the twelve (12) months immediately preceding the event giving rise to the claim — or $100, whichever is greater.

In no event will Surven be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, even if we've been advised of the possibility of such damages.

Some jurisdictions don't allow the limitation of certain damages, so these limits may not fully apply to you.

9. Indemnification

You agree to defend, indemnify, and hold Surven (and our team) harmless from any claim, loss, or legal expense (including reasonable attorneys' fees) that arises from: (a) your breach of these Terms or our Acceptable Use Policy; (b) your use of the service — including the Chrome extension or any auto-fix you authorize — in a way that infringes someone else's rights or breaks the law; or (c) anything you submit to Surven that causes a third-party claim.

10. Governing law, venue & dispute resolution

These Terms are governed by the laws of the State of Connecticut, United States, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the service will be brought exclusively in the state or federal courts located in Connecticut, and you consent to the personal jurisdiction of those courts.

You and Surven agree to resolve any dispute on an individual basis. You waive — and Surven waives — any right to participate in a class action, collective action, or any representative proceeding.

11. Force majeure

We aren't liable for delays or failures caused by events outside our reasonable control — including outages at the AI providers we depend on (OpenAI, Anthropic, Google), network or hosting infrastructure failures, government actions, or acts of nature. If a major outage affects the service for an extended period, we'll communicate the status by email and post updates on surven.ai.

12. Assignment

Surven may assign these Terms in connection with a merger, acquisition, or sale of substantially all of our assets, without your consent. You may not assign your account or these Terms without our prior written consent.

13. Survival

Sections 6 (Data & privacy), 7 (Disclaimers), 8 (Limitation of liability), 9 (Indemnification), 10 (Governing law, venue & dispute resolution), and any other obligations that should reasonably continue, will survive termination of these Terms.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we'll update the "Last updated" date above. Material changes will be communicated by email to the address on your account at least 14 days before they take effect. Continued use of the service after changes take effect means you accept the updated Terms.
